It appears that that party position is State of Jharkhand not the State of Jharkhand & Another but in order dated 20.02.2018 party position has been wrongly typed as State of Jharkhand & Another.

In view of the matter, order dated 20.02.2018 is modified to the extent that party position be read as State of Jharkhand.

The petitioners are apprehending their arrest in connection with Mufassil P.S. Case No. 195 of 2017, corresponding to G.R. No. 2531 of 2017 for the offence under sections 147, 149, 323, 307 of the Indian Penal Code.

Counsel for the petitioners has submitted that the present case is counter-blast of Mufasil P.S. Case No. 194 of 2017 under sections 147, 149, 337, 338, 323, 307, 504 of the Indian Penal Code lodged by Asfaq Ahmed who is son of the petitioner-Mubarak and brother and nephew of other petitioners against the present informant and his family members. It is further submitted that informant and others had brutally assaulted the petitioners with knife and other means causing very serious injuries and remained in hospital. Further, it has been submitted that there is land dispute between the parties.

Learned A.P.P opposed the prayer for anticipatory bail.

From perusal of case diary of Mufassil P.S. Case No. 195 of 2017, corresponding to G.R. No. 2531 of 2017 , it appears that informant of this case namely, Aiyaz Hussain, Nazia Khatoon has received injuries in the injury report it was found that no visible injury was found.

Further from perusal of case diary of Mufassil P.S. Case No. 194 of 2017, it appears that Gulam Rabbani, Asfaque Ahmad, Mubarak Hussain have received injury. Mubarak Hussain was admitted in the Department of Surgery vide ISD No. 8494 on 01.09.2017 with PIR No. 12816 referred from Sadar Hospital Hazaribagh.

It appears that both sides have received injuries.

In the facts and circumstances of the case, considering the fact that there is case and counter-case between the parties, both sides have received injuries, the above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)each, with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Hazaribagh in connection with Mufassil P.S. Case No. 195 of 2017, corresponding to G.R. No. 2531 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C .
