The petitioners are apprehending their arrest in connection with P.C. Case cum Protest Application no. 114/2016, the case registered under Sections 379 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that prior to lodging of this case the informant has filed a case being Seraikella P.S.case no. 92/2013 and the police after investigation has submitted final form on 19.10.2013. It is further submitted that there is civil dispute between the parties. Hence, petitioners deserve bail.
Despite notice issued to the O.P.No.2, no body appears on behalf of O.P.No.2.
Learned A.P.P opposed the prayer for bail.
Keeping in view the arguments advanced by the learned counsel for the parties and also considering the fact and circumstances of the case, the above named petitioners are directed to surrender in the Court below within Four Weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners, on bail, on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of J.M.Ist class, Seraikella, in connection with P.C. Case cum Protest Application no. 114/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
