Sheo Kumar Ram Vs the State of Jharkhnad

Petitioners are apprehending their arrest in connection with Complaint Case No. 499 of 2017, corresponding to T.R. No. 504 of 2017 for the offence under sections 323, 341, of the Indian Penal Code and under section 3/4Preventioin of Witch Practices Act.

The learned counsel for the petitioners has submitted that the present case is counter- blast of Birni P.s. Case No. 26 of 2014 and the present case has been lodged to take revenge from the petitioners.

Learned A.P.P opposed the prayer for anticipatory bail.

Despite valid service of notice, O.P. No. 2 has failed to appear.

Case diary of Birni P.S. Case No. 26 of 2014 has been produced, from perusal of case diary it appears that petitioners side has received injuries.

In the facts and circumstances of the case, the above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Giridih in connection with Complaint Case No. 499 of 2017, corresponding to T.R. No. 504 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C
