Petitioner is apprehending his arrest in connection with Complaint Case No. 221 of 2015, registered under Section 498A of the I.P.C. and Section 3 and 4 of the Dowry Prohibition Act, lodged on the basis of one written report given by Shanti Devi, alleging therein that she was married with this petitioner on 29.04.2013 according to Hindu rites.

It appears that despite valid service of notice, opposite party no. 2 failed to appear.

Learned counsel for the petitioner submitted that prior to lodging of this case, petitioner has filed Baghmara P.S. Case No. 30 of 2015 dated 27.01.2015, registered under Sections 341, 323, 325, 379, 34, 427 of the I.P.C.

It appears that under order dated 23.08.2018, case diary of Baghmara P.S. Case No. 30 of 2015 was called for, which has been received.

From perusal of injury report, it appears that Kiran Mahto (petitioner) has received injury from the hands of brother and father of opposite party no. 2.

Learned APP has opposed the prayer for bail.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The above named petitioner is directed to surrender in the Court below within five weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1^st Class, Dhanbad, in connection with Complaint Case No. 221 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
