The petitioners are apprehending their arrest in connection with the case registered under Sections 147, 149, 341, 323, 324, 307, 427, 447 of the IPC.

Learned counsel for the petitioner has submitted that the petitioners have been falsely implicated due to village politics and not committed any offence whatsoever alleged in the FIR. It is further submitted that as per FIR there is specific allegation against Anil Yadav, who has been granted bail from the court below.

Learned counsel for the State has opposed the prayer for anticipatory bail of the petitioner.

In view of the submission that accused Anil Yadav has been granted bail from the court below, I am inclined to admit the above named petitioners on anticipatory bail. The petitioners are directed to surrender in the court below within four weeks and in the event of their arrest or surrender, the court below shall release them on bail on their furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) eacvh with two sureties of the like amount each to the satisfaction of learned CJM, Deoghar, in connection with Jasidih P.S. case No.417/17, corresponding to G.R.No.1940/17, subject to the condition as laid down under Section 438(2) of the Cr.P.C., and subject to further conditions is that the petitioners shall deposit Rs.2,000/- each before the court below at the time of surrender, thereafter the court

below is directed to issue notice upon the injured/informant and on his appearance and after proper verification shall release the aforesaid amount in his favour under Victim Compensation Scheme. The aforesaid deposition will not prejudice the case of the petitioners.
