Learned counsel for the petitioner submits that the petitioner’s prayer for bail was earlier rejected by this Court vide order dated 17.04.2017 passed in B.A. No. 1193/2017. By way of present bail application, the petitioner has renewed his prayer for bail. The petitioner is the husband of the deceased. It is further submitted that all the witnesses were examined on behalf of the prosecution and the petitioner was also examined under Section 313 Cr.P.C. However, thereafter a prayer was made on behalf of the prosecution for framing alternative charge against the petitioner under Section 302 IPC which was allowed by the concerned Trial Court vide order dated 13.06.2018. Under the said circumstance, the trial of the petitioner has to start afresh and the entire set of evidence has to be recorded once again which would consume considerable time. It is also submitted that the doctor-PW.9 (Dr. Sanjay Kujur) has clearly deposed in his deposition that the cause of death is asphyxia due to strangulation by ligature. Thus, it may be construed that it is not a case of throttling. The petitioner is in judicial custody since 22.05.2016. In view of the said facts, the petitioner may be given the privilege of regular bail.
