The petitioner is an accused for the offence punishable under sections 419, 420, 406/34 of the Indian Penal Code.

Counsel for the petitioner submits that the petitioner is in custody since 30.01.2017 and the case is triable by the Magistrate and till date, inspite of several orders of this Court, Court below has not framed charge.

Taking into consideration the period of custody and the fact that charges have not been framed by the Court inspite of orders,, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Prashant Kumar Sinha @ Prasant Kr. Sinha is directed to be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Latehar, in connection with Latehar P.S. Case No. 146 of 2016, corresponding to G.R. No. 655 of 2016, subject to the following conditions that:-

(i) One of the bailers must be a close relative of the petitioner;

¶9

(ii) Petitioner will deposit his passport, if any, before the learned trial Court;

¶10

(iii) He will not change his place of residence without the prior permission of the learned trial Court;

¶11

(iv) He will appear before the learned Trial court on each and every date so fixed.

¶12

and in the event the petitioner fails to adhere to or comply with any of the conditions or fails to appear before the learned trial Court on any single date so fixed, the trial Court will take all steps for causing arrest of the petitioner again.
