Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioner is an accused for allegedly committing an offence punishable under Sections 25(1-B)a/26 of the Arms Act and Section 17 of the CLA Act. From the possession of this petitioner one country made pistol and one live cartridge were recovered for which he has been languishing in custody from 18.4.2018.
Considering the period of custody, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Hazaribagh in connection with Barhi Police Station Case No. 130 of 2018 (G.R. No. 1100 of 2018).
