Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner.
Petitioner is an accused for allegedly committing the offence punishable under Sections 147, 148, 149, 307, 302, 427, 435 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the Criminal Law Amendment Act, in connection with Sessions Trial No.120 of 2017 arising out of Amrapara Police Station Case No.05 of 2012 corresponding to G.R. No.43 of 2012, pending in the Court of learned Additional Sessions Judge I, Pakur.
There is allegation that the petitioner is a member of an extremist group. He along with his associates committed murder of the Guard. It is alleged that this petitioner had ordered to fire upon the deceased and upon his instructions the other co-accused shot at the deceased Pramod Kumar.
In view of the direct and specific allegation against the petitioner and also keeping in view that the case of the petitioner also stands different to that of Chandra Mohan Marandi and Hiraman Marandi, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner, namely, Ramlal Rai @ Abinash @ Bikram @ Prem Jee @ Chhotu, in connection with Sessions Trial No.120 of 2017 arising out of Amrapara Police Station Case No.05 of 2012 corresponding to G.R. No.43 of 2012, pending in the Court of learned Additional Sessions Judge I, Pakur, is hereby rejected.
This application stands dismissed.
