Learned A.P.P. appearing for the State files counter affidavit in Court. The same be kept on record.

Petitioners are accused for allegedly committing the offence punishable under Sections 385/387/341 and 34 of the Indian Penal Code, in connection with Rikhiya Police Station Case No.07 of 2018 corresponding to G.R. No.161 of 2018, pending in the Court of learned Chief Judicial Magistrate, Deoghar.

Learned counsel for the petitioners submits that it is a case of demand of levy. He submits that one of the co-accused has been granted bail. Admittedly, petitioners have got no other criminal case pending against them. He submits that the petitioners are in custody since 25.02.2018.

Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioners, but, admits that there is no other criminal case pending against these petitioners.

Taking into consideration the period of custody and the fact that there are no criminal case pending against these petitioners, I am inclined to grant bail to the petitioner. Accordingly, petitioners, abovenamed, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Deoghar in connection with Rikhiya Police Station Case No.07 of 2018 corresponding to G.R. No.161 of 2018 subject to the condition that one of the bailers must be a resident of district Deoghar having sufficient landed property in his own name and the other bailer should be a close relative of the petitioners having sufficient landed property in his own name.
