Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner.

Petitioner is an accused for allegedly committing the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code, in connection with Pakur (Mal Pahari) Police Station Case No.187 of 2017 corresponding to G.R. No.849 of 2017, pending in the Court of learned Chief Judicial Magistrate, Pakur.

Petitioner is not named in the FIR. Pultu Sheikh has taken the name of other accused, but, did not identify this petitioner. One of the coaccused has taken name of this petitioner. Save and except the confessional statement of co-accused, there is nothing against the petitioner.

In view of the aforesaid facts, petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Pakur in connection with Pakur (Mal Pahari) Police Station Case No.187 of 2017 corresponding to G.R. No.849 of 2017, subject to the condition that one of the bailers should be a resident of Pakur district having sufficient landed property and another should be a close relative of the petitioner having sufficient landed property in his own name with a further condition that the petitioner will appear and mark his attendance before the Officer-in-Charge, Pakur (Mal Pahari) Police Station once in a month and in the event the petitioner fails to appear before the Officer-in-Charge, Pakur (Mal Pahari) Police Station in any particular month, bail bonds furnished by the petitioner shall stand cancelled and the Officer-in-Charge, Pakur (Mal Pahari) Police Station will take all steps for re-arrest of the petitioner.
