The petitioner is an accused for allegedly committing an offence punishable under Sections 419, 420, 467, 468, 471, 120B/34 of the IPC and Section 66 ( C) (D) of the IT Act.

Counsel for the petitioner submits that there is no evidence of monetary transaction.

Learned A.P.P. assisted by the Investigating Officer opposes the prayer for bail and submits that two mobile phones and SIM Cards were recovered from the possession of this petitioner but admits that there is no evidence of monetary transaction. He submits that petitioner had assisted other accused persons in cyber crime.

Since there is no evidence of monetary transaction through E-wallet, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Giridih in connection with Bengabad Police Station Case No. 68 of 2018 (G.R. No. 683 of 2018).
