Heard learned counsel for the petitioner and the learned A.P.P. appearing for the State.
Petitioner is an accused for allegedly committing the offence punishable under Sections 341, 342, 323, 354, 379, 307, 34 of the Indian Penal Code in connection with Chouparan Police Station Case No.234 of 2017 corresponding to G.R. No.2959 of 2017, pending in the Court of learned Judicial Magistrate at Hazaribagh.
Petitioner is the husband of the informant. There is an allegation that this petitioner and others were pressurizing the informant to withdraw the criminal case lodged by her. When she refused, she was assaulted and her golden chain was snatched.
Learned counsel for the petitioner submits that the petitioner was in custody since 03.11.2017 till the date he was released on provisional bail vide order dated 02.05.2018 passed by this Court. There is no allegation that the petitioner has mis-used the privilege of provisional bail.
Taking into consideration that the petitioner has remained in custody for nearly six months, provisional bail granted to the petitioner vide order dated 02.05.2018 in connection with Chouparan Police Station Case No.234 of 2017 corresponding to G.R. No.2959 of 2017, pending in the Court of learned Judicial Magistrate at Hazaribagh, is hereby made absolute.
This application stands allowed.
