6/ 06.07.2018 Heard learned counsel for the petitioner and the learned A.P.P. appearing for the State.
Petitioner is an accused for allegedly committing the offence punishable under Sections 341/ 323/ 307/ 504/ 498A/ 34 of the Indian Penal Code in connection with Chouparan Police Station Case No.88 of 2017 corresponding to G.R. No.1081 of 2017, pending in the Court of learned Judicial Magistrate 1st Class at Hazaribagh.
This case was listed along with B.A. No.630 of 2018, which arise from an FIR filed by the same informant against the petitioner, who happens to be the husband. In the said case, inspite of filing vakalatnama, opposite party No.2 has not appeared.
Allegation against the petitioner is that the petitioner has assaulted the informant, who is the wife of the petitioner and tortured her also.
Learned counsel for the petitioner submits that the petitioner is in custody since 11.12.2017 till he was released on provisional bail pursuant to order dated 02.05.2018 passed by this Court, i.e., nearly for four months.
Taking into consideration the aforesaid facts, provisional bail granted to the petitioner vide order dated 02.05.2018 in connection with Chouparan Police Station Case No.88 of 2017 corresponding to G.R. No.1081 of 2017, pending in the Court of learned Judicial Magistrate 1st Class at Hazaribagh, is hereby made absolute.
This application stands allowed.
