Petitioner is an accused for allegedly committing the offence punishable under Sections 414/419/420/467/468/471/120(B) of the Indian Penal Code, Sections 66(B), 66(C), 66(D) of the Information Technology Act, in connection with Jamtara Cyber Police Station Case No.05 of 2018 corresponding to G.R. No.214 of 2018, pending in the Court of learned Additional Chief Judicial Magistrate, Jamtara.

Learned counsel for the petitioner submits that there is no transaction from the SIM Card, which was recovered from the possession of the petitioner.

Learned A.P.P. appearing for the State assisted by the Investigating Officer, who is present before this Court, opposes the prayer for bail of the petitioner and submits that the SIM Card, which was recovered from the petitioner does not belong to him and there are several phishing calls from the said mobile. He submits that though there is no monetary transaction from the SIM Card recovered from the petitioner, but the person, who was arrested along with the petitioner, has made several monetary transactions.

Since there is no evidence of any transaction against the petitioner, I am inclined to grant bail to the petitioner. Accordingly, petitioner, namely, Sarban @ Sraban Mandal, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jamtara in connection with Jamtara Cyber Police Station Case No.05 of 2018 corresponding to G.R. No.214 of 2018.
