The petitioner is an accused in connection with Barharwa P.S. Case No. 58 of 2017, corresponding to G.R. No. 339 of 2017, for the offence punishable under sections 302/34 of the Indian Penal Code, pending in the Court of the learned A.C.J.M., Rajmahal.
The petitioner is the husband of the deceased. Deceased died in the matrimonial home. There is allegation of demand of dowry and torture. Deceased was sent to her matrimonial house only on 27.04.2017 and she died on 30.04.2017. Post-mortem report suggests that the death is due to cardio failure secondary to asphyxia. Further there is an antimortem injury which is black linear mark encircled around neck. It is not the defence that the deceased died due to hanging.
Taking into consideration the aforesaid facts, I am not inclined to release the petitioner, namely, Wazir Sk @ Uzir Sk on bail. Accordingly, this application is dismissed.
