The petitioner is an accused in connection with Madhupur P.S. Case No. 407 of 2017, corresponding to G.R. No. 1167 of 2017, for the offence punishable under sections 420/467 of the Indian Penal Code and under section 66(B)/66(C) of the Information Technology Act.
Counsel for the petitioner submits that the amount which was transferred in the account of the petitioner was at the time of marriage ceremony of the petitioner, which has taken place in the month of February, 2017.
Addl. P.P. opposes the prayer for bail of the petitioner and submits that several money transactions were made in the month of May and June 2017 in the account of the petitioner, which clearly suggests that the petitioner is involved in commission of cybercrime by transferring money from the account of other persons.
After hearing the parties and after going through the case diary, I find that prima facie there is substance in the submissions of the Addl. P.P. and as such, I am not inclined to release the petitioner, namely, Santosh Kumar Das @ Santosh Das on bail. Accordingly, this application is dismissed.
Since the petitioner is in custody from the month of December, 2017 and charge has been framed in the month of July, 2018, I direct the trial court to take all possible steps to conclude the trial at the earliest.
