Heard learned counsel for the parties.

The petitioner is an accused for allegedly committing an offence punishable under Sections 420/120-B of the IPC . .

Counsel for the petitioner submits that there is an allegation against this petitioner that he has cheated one lady of West Bengal by fraudulent transferring money from her account. He submits that petitioner was arrested in the said case which is registered at Kolkatta being Vidhannagar Kolkatta Cyber Crime P.S. Case No. 65 of 2017. He submits that he has already been granted bail in that case which was filed against this petitioner in West Bengal. He submits that this case is offshoot of the Kolkatta case, registered when police came to arrest the petitioner. He submits that there is no other material against the petitioner.

Learned A.P.P. opposes the prayer for bail and submits that petitioner was involved in committing cyber crime by transferring money from account of other persons. Petitioner is in custody since 23.04.2018.

Taking into consideration the period of custody and the fact that petitioner has granted bail in the case which was lodged against him in West Bengal, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Dhanbad in connection with Nirsa Police Station Case No. 192 of 2017 (G.R. No. 3137 of 2017), ), with a condition that petitioner will deposit a sum of Rs. 15000/-(RUPEES FIFTEEN THOUSAND) in the Kerela Chief Ministers Distress Relief Fund bearing Account No. 67319948232, State Bank of India, City Branch, Thiruvananthapuram (IFSC Code: SBIN 0070028, PAN: AAAGD0584M, Swift Code: SBININBBT08) and a receipt of the said deposit will be furnished at the time of furnishing his bail bonds.
