Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioner is an accused for allegedly committing an offence punishable under 366(A), 376 of the IPC and Section 4/8 of the POCSO Act.
Statement of the victim was recorded under Section 161Cr.P.C in which she has stated that she was forcibly taken by this petitioner who committed rape upon her against her own will.
In view of the aforesaid fact, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Manika P.S. Case No. 05 of 2018, corresponding to POCSO Case No. 20 of 2018, pending in the court of learned 1st Additional Sessions Judge-cum-Spl. Judge, Latehar stands rejected.
