Learned A.P.P. appearing for the State opposes the prayer for grant of bail of the petitioners.
Petitioners are accused for allegedly committing the offence punishable under Sections 18, 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act.
It is stated that the petitioners and others were cultivating poppy in the forest land.
Learned counsel for the petitioners submits that the petitioners are in custody since 28.11.2017. It has been mentioned in paragraph 6 of this application that there is no criminal antecedents of the petitioners.
In view of the aforesaid facts, petitioners, namely, (1) Manohar Ganjhu, (2) Kuldeep Ganjhu and (3) Khaita Ganjhu, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Principal District Judge-cum-Special Judge, Chatra in connection with Kunda Police Station Case No.07 of 2017 corresponding to R.N.F. 239 of 2017, with a condition that the petitioners will appear and mark their attendance before the Officer-in-Charge, Kunda Police Station, Chatra once in a month, and in the event the petitioners fail to appear before the Officer-in-Charge, Kunda Police Station in any particular month, bail bonds furnished by the petitioners shall stand cancelled and the concerned police will take necessary steps for arrest of the petitioners again.
