Learned A.P.P. appearing for the State opposes the prayer for
grant of bail of the petitioner.
Petitioner is an accused for allegedly committing the offence punishable under Sections 341, 323, 504, 307, 379 and 34 of the Indian Penal Code.
It is stated that because of grazing of cattle, the dispute arose between the parties. The informant was assaulted on her forehead due to which she became injured. Doctor found a hairline fracture on her head. Learned counsel for the petitioner submits that the petitioner is in custody since 31st October, 2017.
Keeping in view the period of custody, petitioner, namely, Dilip Yadav, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Deoghar in connection with Devipur Police Station Case No.38 of 2017 corresponding to G.R. No. 442 of 2017, subject to the condition that the petitioner will appear before the Trial Court on each and every date and in the event the petitioner fails to appear before the Trial Court on any particular date, the bail bonds furnished by the petitioner shall stand cancelled and the learned Trial Court will be at liberty to take all steps for causing arrest of the petitioner again.
