2/6.02.2018 Heard learned counsel appearing for the petitioners and the learned counsel for the State, who opposes the prayer for bail.
The petitioners are accused for allegedly committing offence punishable under Sections 25(1-b)(a), 26, 35 of the Arms Act.
It is alleged that the petitioner nos.1 and 3 were apprehended from the place of occurrence. Though nothing has been recovered from the possession of the petitioner no.1 but from possession of the petitioner no.3 one country made pistol was recovered. These two petitioners confessed their guilt and implicated the petitioner no.2. The petitioner nos. 1 and 3 are in custody since 11.09.2017 and petitioner no.2 is in custody since 17.09.2017.
Keeping in view the aforesaid fact and the period of custody, petitioners, namely, Robin Singh, Deepak Singh and Yogendra Singh are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Palamau, in connection with Chhatarpur, P.S. Case No. 130 of 2017, corresponding to G. R. No. 2035 of 2017, subject to the condition that the petitioners shall appear before the Officer-in-Charge, Chhatarpur Police Station (District Palamau) once in a month and shall mark their attendance. If they fails to appear in any particular month, their bail bonds shall stand cancelled and the Officer-inCharge would be at liberty to arrest the petitioners.
