Heard the counsel for the parties.
Learned A.P.P opposes the prayer for bail.
The petitioner is an accused for the offence punishable under Sections 364, 302, 201 and 34 of the Indian Penal Code and Section 17(i)(ii) of the CLA Act, in connection with Simariya P.S. Case No. 05/2008, corresponding to G.R. No. 12 of 2008, pending in the court of learned Session Judge, Chatra in S.T. No. 18/2018.
This case is of the year 2008. The petitioner was only remanded in this case on 12.7.2017. From the case diary, it is apparent that the petitioner was evading his arrest. The trial of co-accused has been concluded but the petitioner was not put on trial because he was evading from his arrest.
