07/24.10.2018: Counsel for the petitioner hands over the certified copy of the report of the Mediator, DLSA, Jamshedpur and submits that the parties have resolved their dispute out of their free will and the terms of settlement has been arrived at between the parties before the Mediator, DLSA, Jamshedpur.
Counsel for the Opp. Party No. 2 has no objection if the provisional granted to the petitioner vide order dated 16.5.2018 is made absolute.
After hearing the parties and going through the record as well as report of the Mediator, DLSA, Jamshedpur, it appears that the parties have resolved their dispute out of their free will. The certified copy of the report of the Mediator, DLSA, Jamshedpur, which has been produced by the counsel for the petitioner, in which, terms of settlement arrived at between the parties, is kept on record.
In view of the aforesaid facts, the provisional bail granted to the petitioner vide order dated 16.5.2018 is made absolute.
The petitioner will hand over the Demand Draft to Opp. Party No. 2 i.e. wife of the petitioner within four weeks from today in terms of Clause 3 of the terms of settlement arrived at between the parties, in presence of the Secretary, DLSA, Jamshedpur.
Let a copy of this order be communicated to the Secretary, DLSA, Jamshedpur through FAX at the earliest.
