Petitioner is an accused for allegedly committing the offence punishable under Sections 323, 341, 307, 498(A)/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, in connection with Mihijam Police Station Case No.185 of 2017 corresponding to G.R. No.1170 of 2017, pending in the Court of learned Sub Divisional Judicial Magistrate, Jamtara.
Petitioner is the husband. There is allegation of demand of dowry and torture. Petitioner has already remained in custody from 06.03.2018 till he was released on provisional bail vide order dated 09.05.2018. Matter was referred for mediation, but, the same was a nonstarter.
Considering the period, which the petitioner has already remained in custody, I am inclined to allow this application. Accordingly, provisional bail granted to the petitioner vide order dated 09.05.2018 in connection with Mihijam Police Station Case No.185 of 2017 corresponding to G.R. No.1170 of 2017, pending in the Court of learned Sub Divisional Judicial Magistrate, Jamtara is hereby confirmed with a condition that the petitioner will deposit a sum of Rs.20,000/- (Rupees Twenty Thousand) before the Court below within three weeks from today, which shall be disbursed to the opposite party No.2 after proper verification and identification, failing which, bail bonds furnished by the petitioner shall stand cancelled and the Court below will take all steps for re-arrest of the petitioner.
