Petitioner is an accused for allegedly committing the offence punishable under Sections 498(A)/494 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, in connection with Giridih (Mahila) Police Station Case No.17 of 2017 corresponding to G.R. No.1946 of 2017, pending in the Court of learned Chief Judicial Magistrate, Giridih.
Both the lawyers for the petitioner and the opposite party No.2 submit that the dispute between the parties have been resolved and part payment has also been made in a proceeding under Section 125 of the Code of Criminal Procedure. Counsel for the opposite party No.2 submits that opposite party No.2 has got no objection if the provisional bail granted to the petitioner is confirmed.
This case arises out of a matrimonial dispute and since the parties have resolved their dispute, I am inclined to allow this application. Accordingly, provisional bail granted to the petitioner, namely, Dinesh Thakur, vide order dated 23.03.2018 in connection with Giridih (Mahila) Police Station Case No.17 of 2017 corresponding to G.R. No.1946 of 2017 pending in the Court of learned Chief Judicial Magistrate, Giridih, is hereby confirmed.
This application stands allowed.
