Learned A.P.P. appearing for the State opposes the prayer for
bail of the petitioner.
Petitioner is an accused for allegedly committing the offence punishable under Sections 302, 376 and 201/34 of the Indian Penal Code in connection with Barhait Police Station Case No.05 of 2018 (G.R. No.24 of 2018) corresponding to Sessions Trial No.94 of 2018, pending in the Court of learned Additional Sessions Judge I, Sahibganj.
After hearing the parties and on going through the Case Diary, especially paragraph 29 of the same, I find that on the confession of this petitioner, murder weapon has been recovered.
In view of the aforesaid fact, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner, namely, Shiv Lal Tudu, in connection with Barhait Police Station Case No.05 of 2018 (G.R. No.24 of 2018) corresponding to Sessions Trial No.94 of 2018, pending in the Court of learned Additional Sessions Judge I, Sahibganj, is hereby rejected.
This application stands dismissed.
