Heard learned counsel for the parties. The petitioner is an accused for allegedly committing an offence punishable under Sections 363, 395, 412 IPC.

Counsel for the petitioner submits that the petitioner has been implicated in the instant case on the basis of confessional statement of co-accused. He fairly submits that petitioner has criminal antecedent and he was in custody from 26.06.2013 but surprisingly he has remanded in this case on 19.4.2017.

Learned A.P.P. opposes the prayer for bail and submits that though the name of this petitioner has surfaced in this case on the basis of confessional statement of co-accused, there are eight criminal antecedent of the petitioner.

Taking into consideration the fact that name of this petitioner has transpired in the instant case on the basis of confessional statement of coaccused, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Palamau at Daltonganj in connection with Bishrampur Police Station Case No. 06 of 2012 (G.R. No. 78 of 2012), corresponding to S.T. No.401 of 2014 subject to the condition that the petitioner should appear and mark his attendance before the Bishrampur police station in the district of Palamau at Daltonganj once in every fortnight, failing which his bail bond stand cancelled and the officer-in-charge Bishrampur police station will take appropriate steps for his arrest.
