Heard the learned counsel for the parties.

The petitioner is an accused for the offence punishable under Sections 365/34 of the Indian Penal Code and later on Sections 302/201 IPC have been added.

One Vivekanand Kumar @ Bhola was murdered. It is alleged that one Sandeep Kumar Sao along with others has committed the murder of the deceased. During investigation, the petitioner, who happens to be an operator of JCB Machine, was arrested and his statement was recorded, in which, he stated in details that it is Sandeep Kumar Sao who brought his cousin, the deceasedVivekananda Kumar, and thereafter they drank together and Sandeep Kumar Sao has committed the murder of the deceased by throttling and thereafter, with the help of JCB Machine, the earth was dug and the dead body of the deceased was concealed.

From the aforesaid submission, I find that the allegation is against one Sandeep Kumar Sao, who has committed the murder of the deceased. Sandeep Kumar Sao in para 86 of the case diary has also confessed his guilt.

Learned APP along with counsel for the informant has opposed the prayer for bail of the petitioner.

In view of the aforesaid facts, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Sabir Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Koderma, in connection with Domchanch P.S. Case No. 63/2017, corresponding to G.R. No. 948/2017.
