The petitioner is apprehending his arrest in connection with PCR Case No. 367/2015, the case registered under Sections 406/420 of the Indian Penal Code.

Pursuant to order dated 05.04.2018 both the parties are physically present before this court and the possibility of reconciliation between through the process of mediation is explored.

It appears that the complainant has paid Rs. 3,50,000/- to the petitioner in lieu of purchase of Massy Tractor.

In SA the O.P.No.2 has categorically stated that on 29.01.2014 tractor was given to them with an information that relevant papers will be given later on. Thereafter, the complainant has handed over the tractor to one Ramjesh Manjhi for transportation of bricks. But neither bricks nor the tractor was returned to the complainant.

Learned counsel for the petitioner has submitted that petitioner is innocent and he has no hand in the alleged offence. Hence, petitioner deserves bail.

Learned A.P.P opposed the prayer for bail.

It appears that there is no directed allegation against this petitioner.

Keeping in view the arguments advanced by the learned counsel for the parties and also considering the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within Four Weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of CJM, Dumka, in connection with PCR Case No. 367/2015,, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
