Petitioner is apprehending his arrest in connection with Protest-cumComplaint Case No. 842 of 2014 arising out of Katkamsandi P.S. Case No. 297 of 2013 for the offence under sections 323, 341, 307/34 of the Indian Penal Code and under section 3/4D.P. Act.
The learned counsel for the petitioners has submitted that earlier complainant lodged complaint case no. 1946 of 2013 before the court of learned C.J.M, Hazaribag against the accused persons under sections 498A, 323, 341, 307/34 of the Indian Penal Code and under section 3/4D.P. Act which was later on sent to the P.S for its registration and investigation, accordingly, Katkamsandi P.S. Case No. 297 of 2013 was registered and after completion of investigation police submitted final form against the petitioner finding the case untrue.
Learned A.P.P as well as learned counsel for the informant opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the court of Smt. Darshana, learned J.M,
Hazaribag in connection with Protest-cum-Complaint Case No. 842 of 2014 arising out of Katkamsandi P.S. Case No. 297 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
