Petitioner is apprehending his arrest in connection with Complaint Case No. 232 of 2017, registered under Section 420 of the I.P.C.
It appears that initially one complaint case being C/1 Case No. 1097 of 2016 was filed by the opposite party no. 2, which was referred under Section 156 (3) of the Cr.P.C. for institution of the case and accordingly, Sidgora P.S. Case No. 91 of 2016 was registered. Thereafter, the police after investigation has submitted final form in favour of the petitioner. Hence, this protest-cum-complaint case and on the basis of protest-cum-complaint, summons have been issued to petitioner.
Learned counsel for the petitioner submitted that petitioner has been falsely implicated in this case and the dispute between the parties is purely civil in nature.
Learned APP has opposed the prayer for anticipatory
bail.
Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamshedpur, in connection with Complaint Case No. 232 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
