Petitioners are apprehending their arrest in connection with Complaint Case No. 1354 of 2017, registered under Sections 323, 341, 379, 420, 386, 468, 504, 120B / 34 of the I.P.C.
In terms of order dated 20.02.2018, both the parties along with their learned counsels are physically present.
Possibility of reconciliation of dispute through the process of mediation is explored, but it failed.
In course of mediation, it transpired that the opposite party no. 2 has paid Rs. 11,79,000/- to the petitioners after taking loan and is a tractor driver.
The prosecution case does not inspire confidence and appears to be a malicious prosecution.
Be that as it may, I am inclined to admit the petitioners on anticipatory bail. The above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of J.M., Ranchi, in connection with Complaint Case No. 1354 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
