Heard learned counsel for the petitioner and learned counsel for the State as well as learned counsel for the O.P. No.2.

The petitioner is apprehending his arrest in connection with the case registered under Section 498-A of the Indian Penal Code.

On 12.04.2018, both the parties along with their counsel were physically present and explored the possibility of reconciliation between them it appeared that stand of the parties were variance.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. It is also submitted that petitioner is the husband of the complainant. It is also submitted that O.P. No.2 always used to go her parental house in the absence of petitioner. So, the petitioner objected to it and due to the aforesaid reason complainant filed a false case against the petitioner.

Learned counsel for the O.P. No.2 has opposed the prayer for bail and produced the certified copy of the Original Maintenance case No. 10 of 2017 order passed by Principal Judge, Family Court, Godda, which reveals that order dated 02.08.2017 was recalled and Rs. 1,500 still not to be deposited by the petitioner.

In view of the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.

The victim is informed about her two fold-rights namely, right to defend her case in the trial Court by a counsel from legal aid panel and right to rehabilitation scheme of the victim to be formulated by the Legal Services Authority, she has shown her inclination.

The trial Court is directed to issue notice to the O.P. No.2-Afsana Khatoon and thereafter O.P. No.2 will appear before the trial Court and the trial court with an association of Secretary, D.L.S.A, Godda under the supervision of Principal Judge-Cum-Chairman, D.L.S.A, Godda will try to explore the extends of benefits of any of the ten schemes sponsored by Government of India and State of Jharkhand run by NALSA and JHALSA and submit a comprehensive report before this Court for rehabilitation of O.P. No.2 and her son within twelve weeks.

Further, the trial Court is directed to take all coercive steps shall be taken against the petitioner and submit a report to this Court within twelve weeks. List this case after twelve weeks.
