The petitioner is apprehending his arrest in connection with the case registered under Sections 414/34 of the Indian Penal Code and Section 33 Indian Forest Act.

Learned counsel for the petitioner has submitted that the co-accused has been granted anticipatory bail in ABA No.1770 of 2016 passed by this Court.

Learned APP has opposed the prayer for anticipatory bail.

In view of the above, I am inclined to admit the petitioner on anticipatory bail. The petitioner is directed to surrender in the court below within four weeks and in the event of his arrest or surrender, the court below shall release him on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khunti, in connection with Murhu P.S. Case No.21/16, corresponding to G.R. No.104/16, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Subject to the further condition is that the petitioner will deposit Rs.25,000/- in the court below before the surrender.

The aforesaid amount will be deposited subject to the result of the case.
