The petitioner is apprehending his arrest in connection with Barhi P.S. Case No. 226 of 2010, corresponding to G.R. No. 2604 of 2010 for the offence registered under sections 147, 149, 341, 427 and 353 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and other co-accused persons of this case namely Pappu Miyan & Others have been granted anticipatory bail by this Court in A.B.A. No. 1266 of 2016.
Learned A.P.P opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of Smt. Richa Srivastava, learned J.M, Ist Class, Hazaribag, in connection with Barhi P.S. Case No. 226 of 2010, corresponding to G.R. No. 2604 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
