6/ 24.11.2017. Heard learned counsel for the petitioner and learned counsel for State, as also learned counsel for the opposite party No.2. The petitioner is apprehending his arrest in connection with Sadar P.S Case No. 62 of 2015, corresponding to G.R Case No.353 of 2015, for the offence under Sections 341, 353, 448 and 506 of the Indian Penal Code.

Previously, the case was instituted for the offence under Sections 341, 353, 448 & 506 of the Indian Penal Code and Section 3 (x) of the S.C and S.T (Prevention of Atrocities) Act. As such the earlier A.B.A. filed by the petitioner was dismissed.

Upon investigation, the police submitted the final form in the case. The informant filed the protest petition on 1.3.2017 and the impugned order shows that upon inquiry, the cognizance has been taken against the petitioner for the offence under Sections 341, 353, 448 and 506 of the Indian Penal Code. No cognizance has been taken for the offence under Section 3 (x) of the S.C and S.T (Prevention of Atrocities) Act. In view of the fact that after investigation, the police had earlier submitted final form, I am inclined to grant anticipatory bail to petitioner, Ritwik Chakraborty @ Ritwik Chabraborty @ Ritwik Chakarborty. Accordingly, it is directed that in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chaibasa, in connection with Sadar P.S Case No. 62 of 2015, corresponding to G.R Case No.353 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
