02 / 13.07.17 Apprehending his arrest, the sole petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Jaldega P.S. Case No. 37 of 2016 (G. R. No. 422 of 2016 ) registered under Sections 379/ 411 of the Indian Penal Code.

Heard learned counsel appearing for the petitioner as well as learned Addl. PP for the State.

The learned counsel appearing for the petitioner submits that the allegation against the petitioner is that he is the owner of a tempo bearing registration no. OR 14C/5369 from which, certain theft articles were seized by the police. The driver of the tempo has been arrested on the spot. It is submitted that all the allegations against the petitioner are false and the petitioner has no knowledge about the transportation of any theft articles in his tempo. He is ready and willing to deposit cash security. Hence, this petitioner be given the privilege of anticipatory bail.

The learned Addl. PP opposed the prayer for bail but conceded that except being the owner of the tempo, there is no other allegation against the petitioner.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant the privilege of anticipatory bail to the sole petitioner. Hence, in the event of his arrest by the police or surrender within a period of four weeks from the date of this order, he shall be released on bail on depositing Rs. 5,000/- as cash security and furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Simdega in connection with Jaldega P.S. Case No. 37 of 2016 (G. R. No. 422 of 2016 ) subject to the conditions laid down under section 438 (2) Cr. P.C.
