03/12.07.2017 Apprehending their arrest in connection with Azad Nagar P.S. Case No.035 of 2017 corresponding to G.R. No.1288 of 2017 instituted under Sections 406, 420, 467, 468, 471, 120B and 34 of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail.

Heard learned senior counsel appearing for the petitioners and learned Addl.P.P. appearing for the State. Learned senior counsel appearing for the petitioners submitted that the allegation against the petitioners is that they entered into a development agreement on 21.09.2003 and thereafter again in the year 2007 there was a new development agreement entered into by the parties. The informant entered into the agreement in which another co-accused Barka Ullah who promised the informant to pay Rs.3,25,00,000/-(Rupees three crore twenty five laksh) but he did not pay any money to the informant. All the allegations against the petitioners are general and omnibus in nature. It is further submitted that at best, a civil dispute can be made out from the averments made in the F.I.R. All the allegations against the petitioners are false. Hence, the petitioner may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner but submits that on perusal of the F.I.R. the allegation of cheating is made out only against the petitioners.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court of learned Judicial Magistrate, Jamshedpur within four weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Jamshedpur in connection with Azad Nagar

P.S. Case No.035 of 2017 corresponding to G.R. No.1288 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
