04 / 13.07.17 Apprehending his arrest, the sole petitioner has moved this Court for grant of privilege of anticipatory bail in connection with G (F) 672 of 2016 registered under Sections 33, 41 & 42 of the Indian Forest Act.
Heard learned counsel appearing for the petitioner as well as learned Addl. PP for the State.
The learned counsel appearing for the petitioner submits that the allegation against the petitioner is that he is the owner of the tractor which was seized for transporting 100 CFT illegally extracted coal. Learned counsel further submitted that though he is the owner of the tractor but he was not present at the place of the occurrence nor he had any knowledge of the coal being transported in his tractor. He is ready and willing to deposit cash security. Hence, this petitioner be given the privilege of anticipatory bail.
The learned Addl. PP opposed the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant the privilege of anticipatory bail to the sole petitioner. Hence, in the event of his arrest by the police or surrender within a period of four weeks from the date of this order, he shall be released on bail on depositing Rs. 2,000/- as cash security and furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M, Hazaribagh in connection with G (F) 672 of 2016 subject to the conditions laid down under section 438 (2) Cr. P.C.
