2/02.02.2017: Heard the learned counsel for the parties.
The petitioner is an accused in connection with Nawadih P.S. Case No. 175 of 2015, corresponding to G.R. No. 1301 of 2015 (ST No. 28 of 2016/113 of 2016) for the offence under Sections 302, 201 and 34 IPC.
Learned counsel for the petitioner submits that only on the basis of suspicion, the petitioner, who is in custody since 3.9.2015, has been made accused in this case. He further submits that the decease went to her paternal house but while returning, did not reach her matrimonial house and her dead body was found in a forest area.
The learned APP opposes the prayer for bail of the petitioner.
In view of the facts and circumstances of the case, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Addl. District Judge-II, Bermo at Tenughat in connection with Nawadih P.S. Case No. 175 of 2015, corresponding to G.R. No. 1301 of 2015 (ST No. 28 of 2016/113 of 2016) .
