The petitioner is an accused in Nagar Untari P.S. Case no.188 of 2016 registered under Section 386 of the Indian Penal Code.

It is alleged that the petitioner has demanded ransom.

Counsel for the petitioner submits that both this petitioner and the informant were in custody and there was some altercation between them, while they were in jail, as a result of which, to take revenge, this case has been filed by the informant. He lastly submits that one co-accused has been granted by a Bench of this Court, vide A.B.A. No.5086 of 2016.

Learned A.P.P opposes the prayer for bail and submits that there are other cases pending against this petitioner.

Since one co-accused has been granted anticipatory bail and the charge sheet has already been submitted in this case, I am inclined to grant bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Garhwa in Nagar Untari P.S. Case no.188 of 2016, corresponding to G.R. No.1200 of 2016 subject to condition that the petitioner should appear twice in a month before the Officer-in-Charge, Nagar Untari Police Station.
