The petitioner is an accused in connection with Bengabad P.S. Case No. 264 of 2016, corresponding to G.R. No. 3012 of 2016 for the offence under Sections 413/414/34 IPC, Sections 39/40 of the M&M Act, Section 30(ii) of the Coal Mines Act and Section 33 of the Indian Forest Act.
Learned counsel for the petitioner submits that the petitioner, who is in custody since 21.11.16, is neither the owner nor the driver of the truck. He further submits that the petitioner was the passenger of the said truck and has taken lift. Counsel for the petitioner lastly submits that the chargesheet has been submitted in this case.
The learned APP opposes the prayer for bail of the petitioner.
In view of the facts and circumstances of the case, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Judicial Magistrate, 1st Class, Giridih in connection with Bengabad P.S. Case No. 264 of 2016, corresponding to G.R. No. 3012 of 2016.
