02/02.02.2017: Heard learned counsel appearing for the petitioner and learned A.P.P. appearing for the State.
The petitioner is an accused in a case instituted under Sections 147/149/435/427/379 of the Indian Penal Code, Section 17 of the C.L.A. Act and Sections 38, 39 and 40 of UAP Act.
Learned counsel appearing for the petitioner submits that one JCB Machine and two mini Hywa were burnt by some unknown miscreants. The police got information that said mischief was committed by the extremists group, led by Ajay Yadav. The petitioner was apprehended in Untari Road P.S. Case No.23 of 2016 (G.R. No.1137 of 2016) for the offence under Sections 25(1-b) a, 26 of the Arms Act and Section 17 of the C.L.A Act.
It is alleged that the petitioner confessed his guilt and he was implicated in this case.
Admittedly, from the case diary, it is evident that there is no eye witness to the said occurrence and there is nothing, save and except the confessional statement of the petitioner. The mobile phone of the petitioner was alleged to have been used for communicating with one Ajay Yadav.
In view of the said submission, I am inclined to grant bail to the petitioner above-named on furnishing bail bond of Rs. 10000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Palamau at Daltonganj, in connection with Untari Road P.S. Case No. 19 of 2016 , corresponding to G.R. No.1007 of 2016, subject to condition that he would appear twice in a month before the Untari Road Police Station.
