02 /12.06.2017 Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Barkatha P.S. Case No.167 of 2016 (G.R. No. 3448 of 2016) registered under section 429 of the Indian Penal Code read with Section 12 of Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005.

Heard the learned counsel for the petitioner and the learned Addl. P.P. for the State.

The learned counsel for the petitioner submits that the allegation against the petitioner is that he is the owner of Tata Magic vehicle bearing Registration No. WB-37D-1473, which was carrying one ton of raw meat. The learned counsel further drew the attention of this Court to Annexure-2 at running page no.14 which is the report of the Forensic Science Laboratory, Jharkhand, Ranchi, wherein, after examination the result has been given that the flesh was from buffalo source of origin.

It is, further, submitted by the learned counsel for the petitioner that under Section 2(b) of the Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005, the bovine animals have been defined as cow, calf, heifer, bull or bullock but buffalo is not defined in the definition of the bovine animals. Hence the petitioner be admitted to anticipatory bail.

Learned Addl. P.P. opposes the prayer for grant of anticipatory bail.

Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the petitioner Ibrar Khan be admitted to anticipatory bail. Hence, in the event of his arrest or surrender within a period of four weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1^st Class, Hazaribagh in connection with P.S. Case No.167 of 2016 (G.R. No. 3448 of 2016), subject to the conditions laid down under section 438 (2) Cr. P.C.
