02/09.06.2017 Apprehending their arrest the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Latehar P.S. Case No.36 of 2017 registered under Section 379/411/413/34 of the Indian Penal Code and under Section 4/21 of the M.M.R.D. Act.

Heard learned counsel appearing for the petitioners as well as learned Addl. P.P. for the State.

Learned counsel for the petitioners submitted that the sole accused Motikur Rahman has disclosed the name of the petitioners to be involved in extracting of the coal at the time of occurrence which is appearing in para no.-31 of the case diary and also it has been mentioned in A.B.P. No.74 of 2017 passed by the Additional Sessions Judge, Latehar vide order dated 16.05.2017.

Learned counsel for the petitioners however does not want to press anticipatory bail application filed on behalf of petitioner No.3 Md. Rezaur Rahman @ Reyazul Rahman. Hence, the prayer for anticipatory bail by petitioner No.3 is rejected as not pressed.

Learned Addl. P.P. appearing on behalf of the State opposes the prayer for anticipatory bail of the petitioner Nos.1, 2 & 4.

Considering the submissions of counsels and the aforesaid facts and circumstances of the case, I am inclined to grant privileges of anticipatory bail to the petitioner Nos.1, 2 & 4. Hence, in the event of their surrender or being arrested within a period of three weeks from the date of this order, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Latehar P.S. Case No.36 of 2017 (G.R. No.145 of 2017) and depositing Rs.5,000/- each as cash security in the court below subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
