03/12.06.2017 Apprehending their arrest in connection with Manjhgaon P.S. Case No.13 of 2016 instituted under Sections 353/365/414/34 of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioners and learned Addl.P.P. Appearing for the State.

Learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in the present case and has not committed any offence and implicated in this case without any rhyme or reason. It is further submitted that other co-accused namely, Sahbaz @ Sahbaz Ansari has already been granted the privileges of anticipatory bail by a co-ordinate Bench of this court vide order dated 26.04.2017 in A.B.A. No.354 of 2017. Hence, the petitioners may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the court below within four weeks from today and in the event of their arrest/surrender, the court below is directed to enlarge them on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M, West Singhbhum at Chaibasa in connection with Manjhgaon P.S. Case No.13 of 2016 corresponding to G.R. No.409 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to further condition that

petitioners shall deposit Rs.10,000/- each as ad interim compensation to the victimSunil Topno in the court below at the time of surrender.

In case the ad interim victim compensation amount as above is deposited, the court below shall issue notice to the victim- Sunil Topno and on his appearance and on proper verification the court below shall release the aforesaid amount in favour Sunil Topno.

The aforesaid deposit of amount shall not prejudice the case of the
