03/16.06.2017 Apprehending their arrest in connection with Telaiya P.S. Case No.80 of 2017 instituted under Sections 147, 148, 149, 323, 324, 307, 379, 354 & 448 of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioners and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioners submitted that there is a case and counter-case of old enmity between the petitioners and the informant for the same occurrence. Petitioner No.1 first instituted a case which was registered as Telaiya P.S. Case No.79 of 2017 and thereafter this case has been instituted against the petitioners as a counter-case. It is further submitted that other co-accused namely Meena Devi, Chandni Kumari @ Chandni Singh and Aarti Devi have already been granted the privileges of anticipatory bail by a co-ordinate Bench of this court vide order dated 28.04.2017 in A.B.A. No.2416 of 2017. Hence, the petitioners may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court of learned S.D.J.M., Koderma within four weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned
