04 /15.06.2017 Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Telaiya P.S. Case No. 20 of 2017 (G.R. No. 64 of 2017) registered under sections 406, 420, 323 & 504 of the Indian Penal Code.

Heard learned counsel appearing for the petitioner and the learned Addl. P.P. for the State.

The learned counsel for the petitioners submits that the petitioner along with the informant were running a polythene bag manufacturing unit and along with the informant, the petitioner had also invested Rs.2,00,000/-. Unfortunately the said enterprise suffered loss and both, the petitioner as well as the informant suffered loss. Since the money was invested in a joint business, so there cannot be said to be any entrustment of money to the petitioner by the informant. Hence he be given the privilege of anticipatory bail.

The learned Addl. P.P. opposes the prayer for bail.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant privileges of anticipatory bail to the petitioner Shekhar Sao @ Chandrashekhar Sao @ Chandra. Hence, in the event of his arrest or surrender within a period of four weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Koderma, in connection with Telaiya P.S. Case No. 20 of 2017 (G.R. No. 64 of 2017), subject to the conditions laid down under section 438 (2) Cr. P.C.
