02/15.06.2017 Apprehending their arrest in connection with Kharsawan P.S. Case No.01 of 2017 instituted under Sections 147, 148, 149, 341, 342, 323, 353, 332, 504, 506, 120B of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioners and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioners submitted that there is no allegation of any injury being sustained by any person by any of the act being committed by the petitioners. The case has falsely been instituted against the petitioners. Hence, the petitioners may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court of Additional Chief Judicial Magistrate, Saraikella within four weeks from today and in the event of their arrest/surrender, the court below is directed to enlarge them on bail on depositing Rs.2,000/-(Rupees two thousand) each as cash security and on furnishing bail

bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saraikella in connection with Kharsawan P.S. Case No.01 of 2017 corresponding to G.R. No.12 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
